1. Preamble & Definitions.

Please read these Terms and conditions carefully before continuing to use this website or any one of its aps. Viewing and using this website and its content automatically mean you have accepted the present document.
FF. MID-CENTURY DESIGN : Commercial company Design Yourself Concept S.R.L., with its head office at no. 1A, Prof. Ștefan Chicoș Rd., 110354 Pitești, Argeș, Romania, CUI (Sole Registration Certificate) 5618461, known as follows as „FF. MID-CENTURY DESIGN”, „MID-CENTURY.NET”, the „COMPANY” or the „WEBSITE”.
WEBSITE : The www.mid-century.net domain and its sub-domains, including, but not limited to the available internal website.
CONTENT is defined as it follows:
all information on the WEBSITE that can be visited, visualized or otherwise accessed by the use of equipment;
the content of any email sent to its USERS by FF. MID-CENTURY DESIGN by electronic and/ or other means of communication available;
any information communicated to the USER by any means by a FF. MID-CENTURY DESIGN employee, according to the contact information specified or not by the former of the two;
information regarding the products, services and/ or the prices FF. MID-CENTURY DESIGN has available during a certain period of time;
information regarding the products, the services and/ or the prices of a third party FF. MID-CENTURY DESIGN has partnership contracts with, during a certain period of time;
data regarding FF. MID-CENTURY DESIGN or other privileged data of the company.
SERVICE : electronic commerce services exclusively conducted on the portions publicly available of the WEBSITE, in the sense of granting the USER the possibility to order/ contract products and/ or services exclusively using electronic means, after having accepted the Terms and Conditions (the present document).
USER : Natural person that has or obtains access to CONTENT through any electronic means of communication or based on an agreement of use between FF. MID-CENTURY DESIGN and the USER and that requires the creation and use of an ACOUNT.
ACCOUNT : the ensemble of an email address/ a user and a password that allow a single user the access to restricted areas of the WEBSITE, by which access is granted to the SERVICE.
DOCUMENT : the present Terms and Conditions.
DISTANCE AGREEMENT : according to the definition given by the Government Ordinance 130/ 2000 article 2 letter a : the product or services supply agreement entered into by a merchant and a consumer, within a sale system organized by the merchant, that exclusively utilizes, before and at the conclusion of this agreement, one or more distance communication techniques;
NEWSLETTER : periodic information means, exclusively electronic, on the products, services and/ or promotions developed by FF. MID-CENTURY DESIGN during a certain period of time, with no commitment on FF. MID-CENTURY DESIGN’s side regarding the information it contains.
TRANSACTION : the takings and refunds of an amount obtained from the sale of a product/ service by FF. MID-CENTURY DESIGN to the USER, by using the services of the card company accepted by FF. MID-CENTURY DESIGN, regardless of the delivery method.
2. General dispositions.
2.1. The document determines the use terms and conditions of the WEBSITE/ CONTENT/ SERVCICE by the USER.
2.2. The use, including but not limited to the accessing, visiting and viewing of the CONTENT/ SERVICE, implies that the USER adhere to the present terms and conditions, except for the case when the respective content does not have distinctly formulated conditions of use.
2.3. Access to the service is done exclusively by accessing the public WEBSITE available at www.mid-century.net.
2.4. By using the WEBSITE/ CONTENT/ SERVICE, the USER is the sole responsible for all the activities that are associated with its use, for possible damages/ losses determined by their own actions. Also, the USER is responsible for any material, intellectual or electronic damages, or of any other nature, as a result of their own deed/ action to the WEBSITE, CONTENT, service, COMPANY, or any third party that FF. MID-CENTURY DESIGN has entered into agreements with, as per the Romanian legislation in force.
2.5. Should the USER not agree and/ or not accept and/ or revoke their approval already given to the present document:
2.5.1. They renounce the: Access to the service, or to other services offered by FF. MID-CENTURY DESIGN through this WEBSITE, receiving newsletters and alerts and/ or communications from FF. MID-CENTURY DESIGN, be them of any nature (electronic, by phone, etc.), without any further guarantees from FF. MID-CENTURY DESIGN.
2.6. The USER can reconsider their decision to agree with and/ or accept the DOCUMENT at any time, regardless of the form said DOCUMENT will be available under at the time.
2.7. In order to make use of the right expressed under article 2.5, they can contact FF. MID-CENTURY DESIGN or use the links in the CONTENT received from FF. MID-CENTURY DESIGN for this purpose.
2.8. The USER cannot revoke their approval in favour of the DOCUMENT for the duration of an AGREEMENT or until the value of all unhonored AGREEMENTS with FF. MID-CENTURY DESIGN is paid off.
2.9. Should the USER have already paid the value of all their unhonored AGREEMENTS with FF. MID-CENTURY DESIGN and they revoke their agreement expressed in favor of the document for the duration of an ORDER having been made, FF. MID-CENTURY DESIGN will annul the ORDER of the USER without any further obligation of any party toward the other or without that any party demand from the other damages or interests in this matter.
2.10. This WEBSITE addresses only USERS that have dully registered and that have not been suspended or removed by FF. MID-CENTURY DESIGN, regardless of the reason for that.
3. Content.
3.1. All the CONTENT, including but not limited to static images, dynamic images, text and/ or multimedia content present on the WEBSITE is the intellectual property of FF. MID-CENTURY DESIGN or of third parties, case in which the CONTENT can be followed by the original property title and/ or by any other note required by the rightful owner of the respective CONTENT, for which FF. MID-CENTURY DESIGN owns the use and/ or publication rights/ licenses
3.2. The USER is not allowed to copy, transfer, modify and/ or otherwise alter, use, link to, expose, include any content in any other context different from the original one intended by FF. MID-CENTURY DESIGN, the inclusion of any content outside of the FF. MID-CENTURY DESIGN WEBSITE, removing the signs that indicate FF. MID-CENTURY DESIGN’s copyright on the CONTENT, as well as the participation in the transfer, sale, distribution of materials made by the reproduction, modification or presentation of the CONTENT, without the express agreement obtained from FF. MID-CENTURY DESIGN.
3.3. Any CONTENT the USER has or obtains access to, by any means, is under the incidence of this DOCUMENT, in case the CONTENT is not accompanied by a specific and valid agreement of use entered into by them and FF. MID-CENTURY DESIGN, and without any implicit or express guarantee on behalf of FF. MID-CENTURY DESIGN regarding the respective CONTENT.
3.4. The USER can copy, transfer and/ or use the CONTENT only for personal or non-commercial purposes, only if they are not in conflict with provisions of this DOCUMENT.
3.5. Should FF. MID-CENTURY DESIGN grant the USER the right to utilize under the described form, and by a distinct agreement of use, a certain CONTENT, to which the USER has or obtains access as a result of said agreement, the respective right only extends to the CONTENT or CONTENTS defined by the agreement, only for the period of its duration, or of the respective CONTENTS on the WEBSITE, or for the duration mentioned by the agreement, as per the conditions defined in the agreement, if they exist and they do not represent a contractual engagement on FF. MID-CENTURY DESIGN for the respective USER, or any other third party that has/ obtains access to this CONTEST transferred by any means, and that could be or is damaged in any way by said CONTENT, during or after the expiry of the agreement of use.
3.6. No CONTENT transmitted to the USER, by any communication means (electronic, phone, etc.) or acquired by them by accessing, visiting and/ or viewing does not represent a contractual agreement on FF. MID-CENTURY DESIGN’s side, or on the side of the FF. MID-CENTURY DESIGN employee who permitted the transfer of CONTENT, should it exist, toward the respective CONTENT.
3.7. Any use of the CONTENT for other purposes than the ones expressly approved by this document or by the agreement of use accompanying it, should it exist, is strictly forbidden.
4. Contact.
4.1. FF. MID-CENTURY DESIGN publishes on the WEBSITE its full and correct identification data and its contact information for the USER.
4.2. By using the contact form or the service available on the WEBSITE, the USER allows FF. MID-CENTURY DESIGN to contact them by any means available, including electronic means.
4.3. Partially or completely filling out the contact form and sending it does not represent in any way FF. MID-CENTURY DESIGN’s commitment to contact the USER.
4.4. Accessing the WEBSITE, using the information presented within it, visiting pages or sending emails or notifications addressed to FF. MID-CENTURY DESIGN is done electronically or any other communication means available to the USER, thus being considered that the USER agrees to receive notifications from FF. MID-CENTURY DESIGN electronically, including email communications or WEBSITE announcements.
4.5. FF. MID-CENTURY DESIGN reserves the right to not respond to all requests of any nature, received by any means of communication (electronic, by phone, etc).
5. Newsletters and Alerts.
5.1. When the USER creates an account on the WEBSITE, by accepting the terms and conditions they implicitly agree to receive newsletters and/ or alerts from FF. MID-CENTURY DESIGN. The USER can choose not to receive newsletters and/ or alerts by using the specific links, available in every newsletter, or by contacting FF. MID-CENTURY DESIGN and specifically requesting this.
5.2. The data received from the USER with the purpose of sending out the newsletters and/ or alerts can and will be used by FF. MID-CENTURY DESIGN within the limits of the Confidentiality policy, as per the dispositions of article 6.1 of the present document.
5.3. Renouncing to receive newsletters and/ or alerts by the USER can be requested at any time:
5.3.1. By using the link available in any newsletter/ alert received by the USER.
5.3.2. By contacting FF. MID-CENTURY DESIGN, according to the contact information, and without any subsequent obligation of a party toward the other or without any one of the two parties being able to request damages and interests from the other.
5.4. Renouncing to receive newsletters and/ or alerts does not imply renouncing the approval of the present DOCUMENT.
5.5. FF. MID-CENTURY DESIGN reserves its right to select the persons it will send newsletters and/ or alerts to, as well as the right to eliminate from its database any USER that has previously expressed their approval to receive newsletters and/ or alerts, without any future commitment from FF. MID-CENTURY DESIGN or any previous notification of the USER thereof.
5.6. FF. MID-CENTURY DESIGN will not include in its newsletters and/ or alerts transmitted to the USER any type of publicity material as CONTENT that would make any reference to third parties that are not FF. MID-CENTURY DESIGN partners at the time when the newsletters and/ or alerts are being sent out.
6. Confidentiality policy.
6.1. FF. MID-CENTURY DESIGN collects personal and special data on the pages of its websites for the following purposes:
– validating, shipping and invoicing the USER’s orders;
– resolving annulments or issues of any nature regarding an order or an agreement, for the services or products purchased by the USER;
– to ensure the USER’s access to the service;
– sending periodic newsletters and/ or alerts, exclusively in electronic format;
– contacting them, at their express request;
– contacting them, for USER-related aspects;
– statistic purposes.
FF. MID-CENTURY DESIGN operates personal data, and it is inscribed in the Register for personal data processing under no. ______
6.2. FF. MID-CENTURY DESIGN can involuntarily collect other data as well (IP address, visit hour, place of access, name and version of your Internet browser, operating system, including other parameters) supplied by the Internet browser through which access is made to the WEBSITE, and this data can be used by FF. MID-CENTURY DESIGN to improve its services offered to the USERS, or for statistic purposes; except for the case when provisions of the DOCUMENT are infringed, should the result of the USER’s actions be against the interests or produces any kind of damages to FF. MID-CENTURY DESIGN and/or any possible third parties FF. MID-CENTURY DESIGN has partnership agreements at the time.
6.3. The USER has the right to oppose the collection of their personal data and request them being deleted, thus revoking the approval given to this DOCUMENT, and thus renouncing any implicit right specified by it and without any further obligation of any one of the parties toward the other or without any one of the parties having the right to request damages and interests from the other, but only in accordance with the provisions of article 2.8.
6.4. In order to exercise the rights according to the provisions of article 6.3, the USER will contact FF. MID-CENTURY DESIGN, as per the contact data available on the WEBSITE, available on that date.
6.5. Using the contact forms available on the WEBSITE, the USER may request the modification of the data they declared initially to reflect any modification, in case this should exist.
6.6. Should the USER opt for online payment for the value of their order, agreement and/ or agreements, the processing of their banking card data will be done exclusively on servers approved by FF. MID-CENTURY DESIGN.
6.7. FF. MID-CENTURY DESIGN does not request and does not store any kind of information regarding the banking card or cards belonging to the USERS.
6.8. FF. MID-CENTURY DESIGN confidentiality policy refers only to data voluntarily supplied by the USER exclusively on the WEBSITE. FF. MID-CENTURY DESIGN is not responsible for the confidentiality policy of any other third party that can be reached through links, regardless of their nature, outside of the WEBSITE.
6.9. FF. MID-CENTURY DESIGN takes upon itself that the USER’s collected data be used only in accordance with the declared purposes and not make public, sell, rent, license, transfer, etc., the database containing information regarding personal or special data of the USER to any third party that is not involved in the fulfilment of the declared purposes.
6.10. The exception is the situation in which the transfer/ access/ viewing etc., is requested by authorised bodides in the cases provisioned by the regulations in force on the date of the event.
6.11. The banking card company approved by FF. MID-CENTURY DESIGN has the right to access/ view any type of data/ document generated as a result of an online order already emitted, of a cancelled order, agreement, annual agreement or an honoured agreement, in order to investigate any TRANSACTION, should that exist.
6.12. FF. MID-CENTURY DESIGN is not responsible for the defects that can jeopardize the security of the server on which the database containing this data is hosted.
7. Online sale policy.
7.1. Access to the SERVICE
7.1.1. Access to the service is allowed to any USER that registers according to the present Terms and Conditions and that have an account.
7.1.2. To be allowed access to the SERVER, the USER will have to accept the provisions of the present DOCUMENT.
7.1.3. FF. MID-CENTURY DESIGN can limit the access of the USER to the SERVICE, depending on their previous behaviour.
7.1.4. It is prohibited that several USERS partition an account.
7.1.5. Should such accesses be discovered, FF. MID-CENTURY DESIGN reserves the right to cancel or suspend the USER’s access to the CONTENT or to the SERVICE.
7.2. Products and services
7.2.1. FF. MID-CENTURY DESIGN can publish on the WEBSITE information regarding the products, services and/ or promotions practised by it or by third parties that FF. MID-CENTURY DESIGN has partnership agreements with or with whom it is in a partnership with, during a certain period of time and limited by the available stock.
7.2.2. The products and/ or services acquired through the SERVICE are destined exclusively to the personal use of the USER. Should you wish to acquire products in order to resell them, please contact us.
7.2.3. FF. MID-CENTURY DESIGN can limit the acquisition capacity of some and/ or all products or services available on the WEBSITE at a certain time, to one or more USERS in justified cases, such as, but without limitation to: modifying by the USER of the materials presented on the WEBSITE, their reproduction, presentation, development or public distribution, their use for public or commercial purposes, or the use of these materials on another site; any unauthorized use of materials presented on the WEBSITE that could constitute an infringement of the copyright and label laws, as well as other legitimate rights owned by FF. MID-CENTURY DESIGN, the use of mechanisms, softwares or other ways that could lead to the deterioration or disappearance of the WEBSITE, as well as other interventions on behalf of the USER/S and not previously authorized by FF. MID-CENTURY DESIGN.
7.2.4. All prices specific to the products and services presented on the WEBSITE are expressed in EURO. The prices are the final ones. FF. MID-CENTURY DESIGN is VAT-exempt.
7.2.5. For online payments, FF. MID-CENTURY DESIGN is not/ cannot be made responsible for any other additional cost supported by the USER, including but not limited to monetary conversion commissions applied by the bank that issued the USER’s card, should the currency of the card be different from RON. The USER is the sole person responsible for this action.
7.2.6. All information used for the description of the products and/ or services available on the WEBSITE (texts/ static/ dynamic images/ multimedia presentations, etc.) does not represent a contractual obligation on FF. MID-CENTURY DESIGN’s side, these being only for presentation purposes.
7.2.7. In the description of the products and/ or services, FF. MID-CENTURY DESIGN reserves the right to utilize other products as well (accessories, etc.) whose costs can not be included in the cost of the respective products.
7.3. Validity of the offer
7.3.1. FF. MID-CENTURY DESIGN can modify its prices for the products and/ or services available on the WEBSITE by updating the data directly on the WEBSITE.
7.3.2. The acquisition price of the products and services is the one from the moment the order was issued, within the limit of the available stock.
7.3.3. The acquisition price of the products and services is the one valid when the order was issued, within the limit of the available stock and/ or of the promotion period, should this be defined.
7.3.4. The acquisition price of the products and services in an order issued cannot be modified at a subsequent date unless it has the agreement of the parties involved.
7.3.5. The acquisition price of the products and services of an agreement honoured as per the provisions of article 7.6.3. cannot be modified.
7.3.6. The USER can renounce the products and services acquired by their order, only within the time period from when the order was issued until it is transformed into an AGREEMENT as per article 7.4.7, or in the cases provisioned by the Return policy.
7.3.7. The USER can renounce the products and/ or services acquired by agreement, as per the provisions of article 7.9.
7.4. Online order
7.4.1. The USER can make orders of products sold at a certain time, exclusively on the WEBSITE. 7.4.2. By finalizing the order, the USER declares that all data provided by them, required for the purchasing process, is correct, complete and true at the date the order is placed, named in this DOCUMENT, and the order issued.
7.4.3. By finalizing the order, the USER agrees that FF. MID-CENTURY DESIGN can contact them, with the following purposes/ situations, by any means available/ approved by FF. MID-CENTURY DESIGN, as per purpose/ situation:
7.4.3.1. The issuing bank of the USER’s card does not accept the TRANSACTION, in the case of a card payment.
7.4.3.2. Invalidation of the TRANSACTION by the card company approved by FF. MID-CENTURY DESIGN, in the case of a card payment.
7.4.3.3. Validation of the availability of the products and quantities acquired by the USER.
7.4.3.4. Validation by the USER of the value of the order they placed, as per article 7.4.3.3, and including, depending on the situation, other services with added value (i.e. transportation, etc.)
7.4.3.5. Mutually determining the delivery details for the products ordered.
7.4.3.6. In any other situations in which FF. MID-CENTURY DESIGN considers it necessary to contact the USER to appropriately perfect the details of the order/ delivery of products/ services requested by the USER and/ or to counteract/ resolve, respectively, any situations/ issues that may intervene as a result of the USER accessing the WEBSITE.
7.4.4. FF. MID-CENTURY DESIGN can automatically denounce the order placed by the USER, without any further obligation of any one the parties toward the other or without that any one of the parts claim damages and interests from the other, in the following situations:
7.4.4.1. The issuing bank of the USER’s card fails to accept the TRANSACTION, for online payments.
7.4.4.2. Invalidation of the TRANSACTION by the card processor approved by FF. MID-CENTURY DESIGN, for online payments.
7.4.4.3. The data provided by the USER on the WEBSITE is incomplete or incorrect.
7.4.4.4. The USER’s activity on the WEBSITE can and/ or produces damages of any nature to FF. MID-CENTURY DESIGN and/ or to its partners;
7.4.5. The USER can cancel an order already issued, when they are contacted according to the provisions of article 7.4.3.
7.4.6. If the USER cancels an order made on their credit or debit card and where the USER’s card issuing bank has already authorized the transaction, in the sense of blocking in the USER’s account the value of the products and/ or services purchased by them, this amount will be released by FF. MID-CENTURY DESIGN in a maximum of 48 business hours from the date when FF. MID-CENTURY DESIGN became aware of this situation.
7.4.7. If some of the products ordered by the USER on their card are not available in stock, FF. MID-CENTURY DESIGN will inform the USER regarding this aspect and will dispose the release of the value of the respective products back into the USER’s account, if the respective amount was already blocked in the USER’s account, in a maximum of 48 business hours from the date FF. MID-CENTURY DESIGN became aware of this situation.
7.4.8. If the USER chose to pay with their credit or debit card and the value of the products/ servies ordered was blocked in their account, the USER has the right to modify the content of their order when they are contacted by FF. MID-CENTURY DESIGN as per the provisions of article 7.4.3., within the limit of the amount blocked in their account.
7.4.9. If the USER modified their order as per article 7.4.8, and the value of their new oder is smaller than the value of the products/ services ordered initially, FF. MID-CENTURY DESIGN will dispose the release into the USER’s account of the value of the difference between the initial value of the order and the new one, in a maximum of 48 business hours from the date FF. MID-CENTURY DESIGN became aware of this situation.
7.4.10. From the moment the USER validates the value of their order or when FF. MID-CENTURY DESIGN informs the USER regarding their validated order, said order becomes a DISTANCE AGREEMENT, as per the provisions of Government Ordinance no. 130/2000, article 2.
7.4.11. The delivery details of the products including, but not being limited to the time necessary for the delivery constitutes contractual obligation on FF. MID-CENTURY DESIGN’s side, in which case the company’s responsibility can be exclusively engaged when the USER proves the guilt and the prejudice caused by FF. MID-CENTURY DESIGN or by its business partners.
7.4.12. If a USER modifies their personal data using the forms available on the WEBSITE, all agreements under way at the time maintain the data defined/ accepted by the USER before the moment of said modification.
7.5. Telephone order
7.5.1. The USER cannot place telephone orders.
7.6. Agreement and finalization
7.6.1. FF. MID-CENTURY DESIGN will include in the package shipped to the USER all documents necessary to prove the purchase of the products/ services by the USER.
7.6.2. FF. MID-CENTURY DESIGN will make all due diligence to inform the USER on the stages of finalization of their order or agreement.
7.6.3. The documents showing the delivery to the USER of the products contracted by them represent, from FF. MID-CENTURY DESIGN’s perspective, an HONORED CONTRACT.
7.7. Transportation
7.7.1. The USER disposes of several transportation options for the purchased products/ services, options out of which he has the obligation to choose only one.
7.7.2. The shipment of the package will be made within 24 business hours from when the order is confirmed by FF. MID-CENTURY DESIGN. FF. MID-CENTURY DESIGN work schedule is available under the Contact section of the WEBSITE. In the case of an online payment by credit or debit card, or a wire transfer, the delivery time of 24 business hours starts from the moment when the payment is confirmed in FF. MID-CENTURY DESIGN’s account. Depending on the shipment method selected, as well as on the address, the DELIVERY may take between 1 and 5 days, anywhere in Romania, up to 14 days in the European Union and up to 30 days outside E.U. The details are available on the Payment and delivery page of the WEBSITE.
In exceptional situations (such as those generated by heavy snows, floods, etc.), the delivery of the products may be prolongued with up to 7 business days. If even after the expiry of the additional 7 business days the product (s) cannot be delivered, FF. MID-CENTURY DESIGN takes it upon itself to inform the USER regarding this impossibility, and for those situations in which the USER has already made the payment of the products with their credit or debit card (online), the amounts they transferred as payment will be refunded by FF. MID-CENTURY DESIGN in a maximum of 30 days from the date of notification regarding the impossibility of the delivery, except for the cases when the USER agrees with the extension of the delivery term.
7.8. Quality and guarantees
7.8.1. Certain products may benefit from a contractual guarantee and this will be mentioned in the product chart/ guarantee certificate at the time of its sale exclusively on the www.mid-century.net WEBSITE. Clear details regarding these guarantees are given in the product charts/ guarantee certificate and no USER can request extended guarantee beyond the one mentioned. Since the products available on FF. MID-CENTURY DESIGN are not new, according to the legislation in force, we offer only a guarantee of authenticity and conformity.
7.8.2. FF. MID-CENTURY DESIGN does not guarantee the availability in stock of any product/ service available for purchase on the WEBSITE.
7.9. Returning products
7.9.1. The USER can return the products purchased through an Agreement, in the following situations:
7.9.1.1. The packages are severely damaged;
7.9.1.2. The products were incorrectly delivered;
7.9.1.3. All products have other specifications or defects than the ones mentioned in their description (they do not comply to their respective descriptions);
7.9.1.4. The consumer has the right to single-handedly denounce the DISTANCE AGREEMENT, without the obligation to pay any penalties and without invoking any reason, within 14 business days from the date the product was received, or, in the case of services received, from the date the agreement was entered into. The only costs that can be imputed to the consumer are the direct product return costs for” as per the provisions of the Government Ordinance 34/2014, for natural persons acquiring products on websites, using distance communication techniques, applying the definitions mentioned in the respective Ordinance 34/2014. 7.9.2. The USER has the obligation to notify FF. MID-CENTURY DESIGN their intention to return the products they purchased, in writing, in a maximum of 14 business days from the date the products/ services were received, in the case of article 7.9.1.4.
7.9.3. The USER who notified FF. MID-CENTURY DESIGN as per the provisions of article 7.9.2 / article 7.9.3, has the responsibility to ensure that the products they referred to will be returned to FF. MID-CENTURY DESIGN in a maximum of 10 business days from the date the written notification was sent out, otherwise FF. MID-CENTURY DESIGN will consider the request as unfounded/ not valid.
7.9.4. The FF. MID-CENTURY DESIGN USER cannot return the products acquired through an Agreement, and/ or they cannot request any other damages and claims, in the following situations or having the following purpose:
7.9.4.1. The replacement of the purchased product with another product with different specifications or of a different type, except for the situation under article 7.9.1.4
7.9.4.2. The return request in case of article 7.9.1.1 or 8.7.1.2 caused by any situation under article 7.9.1 has a shipping date that exceeds the period of 14 business days provisioned according to article 7.9.1.4, from the work day following the date of the honored contract.
7.9.4.3. In case of returning the product under one of the causes declared in article 7.9.1, the returned product is not in the same condition in which it was delivered (in its original packaging with all labels intact and with the accompanying documents).
7.9.4.4. As per the provisions of Government Ordinance 130/2000 article 10 letter c., FF. MID-CENTURY DESIGN reserves the right to not accept the return of those products that, by their nature, cannot be returned or that can degrade or deteriorate very quickly.
7.9.5. In the case of refunding the value of the product, this will be done in a maximum of 30 days from the confirmation of the return.
7.9.6. In the case of replacing the product with an identical/ similar one, the replacement will be made according to the conditions and limitations of a regular order.
7.9.7. If the USER returned a product, and FF. MID-CENTURY DESIGN does not have an identical/similar product to replace it, the company will offer the USER the value of the returned product in a maximum of 30 days.
7.10. Any USER that makes an order on www.mid-century.net has the obligation to pay the final price and pick up the package. If they refuse to receive the package, even though said package is not severely damaged, or they fail to turn up at their local postal office/ courier company to pay for and pick up the package, they have the obligation to deposit in the COMPANY’s account the value of the round trip for the order they made, the cost depending on the delivery method they opted for, in a maximum of 7 business days; the company’s account is indicated at the beginning of this DOCUMENT, as well as in the Contact section of the WEBSITE.
8. Fidelity Reward Program(s).
8.1. FF. MID-CENTURY DESIGN reserves the right to establish various programs in order to reward its customers loyalty.
8.2. One of the fidelity programs is called FIDELITY POINTS. For each acquisition, customers earn points according to the following rule: 3 FIDELITY POINTS for every 100 euros spent.
8.3. If not used, the FIDELITY POINTS accrue after each purchase and can be used at any time. From your client account you can see, at any time, the number of FIDELITY POINTS you have.
8.4. The points can be used to get discounts on the following purchases, according to the following rule: 1 FIDELITY POINTS equals 1 € (for example: if you have 15 points and you use them, your invoice will drop 15 euros).
8.5. Customers who buy up to 3.000 € from FF. MID-CENTURY DESIGN are considered SILVER CLIENTS. After each purchase on our site, the points received under Article 8.4. will be doubled by a site administrator and added to their FIDELITY POINTS BALANCE (for example, if you are a SILVER CLIENT and you have received 25 points for your purchase, a site administrator will add another 25 points to your fidelity points balance).
8.6. Customers who buy up to 10.000 € from FF. MID-CENTURY DESIGN are considered GOLD CLIENTS. After each purchase on our site, the points received under Article 8.4 for that purchase will be tripled by a site administrator and added to their FIDELITY POINTS BALANCE (for example, if you are a GOLD CLIENT and you have received 25 points for your purchase, a site administrator will add another 50 points to your fidelity points balance).
8.7. After each purchase in which you redeem FIDELITY POINTS, the number of points used will be deducted from your customer account.
8.8. The FIDELITY POINTS can not be converted into cash money. They can only be used to obtain discounts on our site.
8.9. In addition to the points awarded according to the articles 8.4., 8.5. and 8.6., FF. MID-CENTURY DESIGN reserves the right to supply customer accounts with points when it has special promotions or discretionary, whenever it decides.
8.10. If you delete your FF. MID-CENTURY DESIGN customer account, your FIDELITY POINTS will be lost and will not be recovered if/when you create a new account.
8.11. We reserve the right to change the our loyalty program(s) rules at any time without prior notice.
9. Fraud.
9.1. FF. MID-CENTURY DESIGN does not request from its USERS, by any communication means (email/ phone/ SMS/ etc.) information regarding confidential data, accounts/ credit or debit cards, or personal passwords.
9.2. Exception from article 9.1 are only those USERS who are judicial persons, in the sense of obtaining by FF. MID-CENTURY DESIGN of the account number and of the USER’s bank, respectively, for invoicing purposes, if need be.
9.3. The USER takes full responsibility for divulging confidential details to a third party.
9.4. FF. MID-CENTURY DESIGN does not take any responsibility in the situation in which a USER were to be/ is prejudiced in any way by a third party that claims to be/ represent FF. MID-CENTURY DESIGN’s interest.
9.5. The USER will inform FF. MID-CENTURY DESIGN regarding such attempts, using the contact details. 9.6. FF. MID-CENTURY DESIGN does not promote SPAM. Any USER that explicitly provided their email address on the WEBSITE can opt for it to be removed.
9.7. Communications made by FF. MID-CENTURY DESIGN by electronic means of communication (email) contain the sender’s full and correct identification details or links to them, at the time the CONTENT is sent.
9.8. The following purposes reached or not, will be considered attempts to fraud the MIDE-CENTURY WEBSITE and a criminal inquest will be conducted against those who attempted or reached said purposes:
9.8.1. to access data of any type belonging to a different user by using an account or any other method.
9.8.2. to alter or modify in any other way the CONTENT of the WEBSITE or the CONTENT sent out by FF. MID-CENTURY DESIGN to the USER.
9.8.3. to affect the performance of the server (s) the WEBSITE is on
9.8.4. to Access or divulge to any third party that does not have necessary legal authoritzation the CONTENT sent out by FF. MID-CENTURY DESIGN to the USER, when they are not the legal recipient of the respective CONTENT.
10. Limited liability.
10.1. FF. MID-CENTURY DESIGN cannot be held responsible by any natural or juridical person that uses or relies on the CONTENT of the WEBSITE.
10.2. FF. MID-CENTURY DESIGN makes all the effort that the information presented in its CONTENT be as exact, real and accurate as possible. However, FF. MID-CENTURY DESIGN does not guarantee that the information is exact, complete or objective, for this reason no one should rely on them for any purpose. FF. MID-CENTURY DESIGN will not be responsible to any person or company that uses or relies on information or non-accurate opinions contained by this website.
10.3. FF. MID-CENTURY DESIGN cannot be held responsible for any kind of prejudice (direct, indirect, accidental or not, etc.) that results from the use or from the incapacity to use the CONTENT-type information presented or not on the WEBSITE, or for any kind of errors or oversights in the presentation of the CONTENT that could lead to any kind of loss.
10.4. Should a USER consider that a CONTENT sent out through any means by FF. MID-CENTURY DESIGN violates copyrights or any other rights, they can contact FF. MID-CENTURY DESIGN for details, as per their agreement details, so that FF. MID-CENTURY DESIGN can make a decision once it has become aware of the situation.
10.5. FF. MID-CENTURY DESIGN does not guarantee the USER’s access on the WEBSITE or to the service and does not grant them the right to download or modify, partially or integrally, the CONTENT, to partially or integrally reproduce the CONTENT, to copy or to exploit any CONTENT in any other way, or to transfer to any third party any CONTENT to which they have/ obtained access, based on an agreement of use, without previous written approval obtained from FF. MID-CENTURY DESIGN.
10.6. FF. MID-CENTURY DESIGN is not responsible for the CONTENT, the quality or the nature of other websites that can be reached from links included in the CONTENT, regardless of the nature of said links. For the respective websites, the responsible falls integrally on their owners.
10.7. FF. MID-CENTURY DESIGN is exonerated of any guilt in the case of use of the websites and/ or CONTENT transmitted to the USER by any means (electronic, by phone, etc.), through the websites, emails or a FF. MID-CENTURY DESIGN employee, when this use of the CONTENT can or it produces damages of any nature to the USER and/ or any third party involved in this transfer of CONTENT.
10.8. FF. MID-CENTURY DESIGN does not offer any direct or indirect guarantee that:
10.8.1. the service will suit the USER’s requirements
10.8.2. the service will be uninterrupted, safe or without any kind of errors
10.8.3. the products/services obtained free of charge or at a cost through the service will be up to par with the USER’s requirements or expectations
10.9. The operators, administrators and/ or owners of the WEBSITE are not liable in any way for the relations or their consequences resulting from, but not limited to, acquisitions, special offers, promotions, sales, or any other type of relation/ link/ transaction/ cooperation, etc., that may appear between the USER and anyone that promotes their business directly or indirectly on the WEBSITE.
10.10. The products commercialized on the WEBSITE can be trademarks of companies. The use of any name of trademark represents the responsibility of each USER. FF. MID-CENTURY DESIGN will not be held liable in front of any person or company for the use without right by the USERS of trademarks CONTAINED on this WEBSITE.
10.11. FF. MID-CENTURY DESIGN is not responsible for the texts/ opinions published by the USERS in – but without limitation to – the COMMENTS section or REVIEW section of the WEBSITE. The responsibility of their formulation is strictly that of the author of the text/ opinion.
10.12. FF. MID-CENTURY DESIGN makes its own regulations for promotions and contests it organizes. These regulations are brought to the attention of possible participants through its own WEBSITE or in newsletters/ alerts. Only those orders that correctly respect the regulation posted on the WEBSITE will benefit from promotions. FF. MID-CENTURY DESIGN can interrupt or cancel any promotion at any time without any previous notification.
11. Force majeure and fortuitous events.
11.1. Excepting cases in which it has been otherwise stated, no one of the two parties of an agreement entered into as per the provisions of article 7.4.8., which is still open, will not be responsible for the non-execution on time or in an appropriate way, totally or partially, of any of the obligations incumbent based on the contract, if the lack of obligation of the respective obligation was caused by an event of force majeure.
11.2. The party or the legal representative of the party that invokes the above-mentioned event has the obligation to notify the other party immediately and completely on the production of the respective event and to take any measures available to limit the consequences of the respective event.
11.3. The party or the legal representative of the party that invokes the above-mentioned event is exonerated from this obligation only in case the event impedes it to dully accomplish said obligation.
11.4. If within 15 days from the date of the respective event, it does not stop, each party will have the right to notify the other party the rightful conclusion of the contract without the other having the right to request damages and interests.
11.5. The party invoking the force majeure event must present the proof of the impossibility to execute their obligation within 30 days from the date the event was produced, but in the limits outlined in article 11.3.
12. Litigation.
12.1. By using / visiting / viewing etc. the Site and / or any content sent by FF. MID-CENTURY DESIGN to users, by accessing and / or sending informations by any means (electronic, telephone, etc.), the user agrees at least with these Terms and Conditions.
12.2. Any dispute regarding the present Terms and Conditions may arise between the user and FF. MID-CENTURY DESIGN will be resolved amicably.
12.3. FF. MID-CENTURY DESIGN is not responsible for any loss, costs, lawsuits, claims, expenses or other liabilities if they are directly caused by noncompliance with the terms and conditions.
12.4. Any dispute of any kind, outside of the regulated article. 12.2 that may arise between users and FF. MID-CENTURY DESIGN or its partners will be resolved amicably. If it will not be possible, the conflict will be resolved in court of competent courts in Arges County, according to Romanian laws in force.
12.5. If any of the above terms will be found null or invalid for any reason, this clause will not affect other provisions.
12.6. This document has been drafted and will be construed in accordance with Romanian law.
13. Final dispositions.
13.1. FF. MID-CENTURY DESIGN reserves its right to make any modification to these Terms and Conditions, as well as any modifications to the WEBSITE/ its structure/ the service, including modifications that could affect the WEBSITE and/ or any CONTENT. These changes will come into force from the moment of their publication on the WEBSITE.
Should the USER continue to use/ visit/ view the WEBSITE and/ or any CONTENT of the WEBSITE after revision, this behaviour values as complete acceptance of the Terms and conditions, as they have been revised/ modified/ completed.
13.2. FF. MID-CENTURY DESIGN will not be held responsible for possible errors on the WEBSITE determined by any cause, including because of certain modifications, settings, etc., that are not performed by the WEBSITE administrator.
13.3. FF. MID-CENTURY DESIGN reserves the right to introduce publicity banners of any nature and/ or links on any page belonging to the WEBSITE, observing the legislation in force.

14.2. Any comments, questions, feedback, ideas, suggestions or other communication or information regarding or referring to the WEBSITE www.mid-century.net, its functionality or improvement will remain under the ownership of FF. MID-CENTURY DESIGN. Thus, we will exclusively own the rights on their application without being liable of any compensation toward you.
14.3. The technical or functional support from the team that maintains this WEBSITE is offered within our possibilities, this support not being guaranteed in any way. However, efforts are made to respond to all the issues and questions received from the WEBSITE’s USERS.
15. Copyright.
15.1. Elements of the WEBSITE’s CONTENT – Web design elements, scripts, programs, databases, are owned by FF. MID-CENTURY DESIGN under any ownership title. The use of any of the elements mentioned above, without approval obtained from FF. MID-CENTURY DESIGN, is punishable according to the legislation in force.
